EHRC’s practical guidance on single-sex spaces is welcome
The Institute’s Solicitor Advocate Sam Webster joins Ciarán Kelly to explain the significance of new guidance from the Equality and Human Rights Commission which clarifies that men who identify as women can legitimately be excluded from female-only spaces.
Sam makes it clear that there is no blanket ban on transgender people but areas such as changing rooms, fitness classes, refuges and rape counselling clinics may reasonably require that the spaces are explicitly reserved for biological women in order to protect those women’s dignity and privacy. Consideration is also given for religious belief.
